how to take legal steps?
my sis bought a 6 weeks old JRT frm a seller thru petfinder. the seller says it has MKA cert n microchip.
then her jrt had a few issues after several weeks.
1) doctor diagnoss it to hav brain problem. this causes it to walk awkwardly.
2) probably due to the brain problem also, it's head is tilted side ways half the time.
3) the jrt ears stands up instead of dropping down like it suppose to.
it makes me wonder whether it's a pure jrt or not. i called the seller n was informed that he was helping his friend to sell the puppy. i demanded to know his friend's name n contact but he refuses to give it to me. i've used the microchip no to check with mka but mka is unable to trace it without the original owner's name.
my sis loves the puppy very much n doesnt care whether is a pure breed jrt or not. but i on the other hand, i just dont wished to be conned.
so r there any steps that i can take to find out whether the jrt is pure breed or not? n also whether it's registered with mka already?
pls help!

Re: how to take legal steps?
Tomaz,
Did the doctor say whether your dog developed those problems during the recent weeks, or did he already have such problems/symptoms when you bought him? That is a more serious issue, if the pet merchant is knowingly selling you an unhealthy puppy.
Please let us know which pet merchant it is and his PetFinder profile, and we will request him to explain the situation in this forum as well. We will give the opportunity to both sides to explain their sides of the story, and to work out an amicable solution whenever possible.
You should also obtain the original owner's name from the pet merchant - if he (or his friend) microchipped the dog and registered with MKA, then they should have that information available.
If the pet merchant does not provide a satisfactory response, then we will blacklist him from our website accordingly.

Re: how to take legal steps?
according to my sis, the doc says this problem is inherited (genetic probably). there's not much that can be done for the pup. it seems to be fine. it is as playful n active as a JRT should be. the seller is not a backyard breeder as far as i know.
as for me, i just wanna find out whether this pup is registered with MKA as he claimed or not. i hav the microchip no n i did call MKA but MKA claims they also need the original owner's name to verify. as i mention that this information was refrained from me by the seller.

Re: how to take legal steps?
Tomaz,
Please PM me the profile of the seller, and I'll have our admin team contact him to try and obtain the necessary information.
I suggest that you register your ownership and microchip details at our Central Microchip Database ( http://www.petfinder.my/microchip.htm) and with MKA as well, so you are reigstered as the rightful owner of this pet.

Re: how to take legal steps?
Sorry for bumping this post after a few months but am new to the forum and just wanted to add my 10cents. Although it is more a potential warning for people looking to get a dog in the future rather than a solution for you. I really hope you managed to resolve the situation and that your puppy is now happy and healthy.
If your puppy's brain problem is in fact inherited, chances are you did stumble into a backyard breeder as a good breeder would never allow a puppy with such a severe problem to be sold. If it did turn out that one slipped through the net they would immediately offer a refund, help with medical expenses or a replacement when you informed them of the problem.
Generally it is a good idea to visit your breeder of choice before deciding to buy a puppy. A responsible breeder will be more than happy to show you everything you wish to see (as long as the puppies are old enough to receive guests). You should be able to see both the dame and sire (or at least a picture and MKA cert) if a stud service was used. A responsible breeder will also be happy (and even prefer) to answer lots of questions about care for the puppy, their temperament, and good AND bad points to the breed and any other queries you have.
Finally a responsible breeder will want to ask you some questions about how capable you are of taking care of their 'baby' (yes to a responsible breeder each of their puppies is like their own child and they want to make sure they all get a good home). They will ask you things like how many people live in your house, if you have children, what kind of space the dog will have, what is your budget for caring for the dog, why you want that breed and even how much research you have done and what pets you currently have/have had in the past.
Of course this is all in an ideal world, i think even a lot of responsible breeders in this country don't go quite that far. The Malaysian mentality makes it quite difficult for a breeder to be so picky so often they have to settle for getting a good feeling about potential owners ;).
Of course a puppy from a responsible breeder will often cost slightly more than the puppies you see lined up in a pet shop window or backyard breeder, however the money you spend initially is less than the money you could be spending to fix all your puppies problems in the future.
It is up to us as dog owners to raise the standards for breeders in this country by being selective about who we take our dogs from. Backyard breeders and Puppy mills are hell on earth for dogs, yet big business for the breeders, they will keep breeding if we keep buying. Make sure your next puppy comes from a caring breeder who is doing it for the love of the breed, not the love of money.
